Summary
Graham Maciver has a varied civil practice incorporating private, commercial and administrative law. He appears before the Court of Session, Sheriff Courts and at Tribunal level, and is available for written and advisory work. He is straightforward in case management and resolution, with flexibility to tailor his approach according to Agents’ and clients’ requirements.
Before calling at the Bar, Graham Maciver was a lawyer with the Foreign & Commonwealth Office, advising on a wide range of international and domestic issues, including litigation, legislation and negotiation. With his background and interest in government, Graham is keen to develop his experience in public law, judicial review and related areas.
Cases of note
- Venture Drilling AS v Larsen Oil & Gas Ltd and others (unreported) – high-value commercial litigation involving: repatriation of funds from foreign jurisdiction; vessel charter; international arbitration. Junior counsel to Ronnie Clancy QC.
- HMA v Marshall Ronald and others (2010 SCL 972); Jones v HMA (2010 SCCR 523) – preliminary hearing of prosecution for extortion following theft of painting ‘Madonna of the Yarnwinder’, and appeal thereof: plea in bar of trial; entrapment; police conduct. Junior crown counsel to Alan Mackay.
- Nolan v First Glasgow Ltd (2009 SCLR 70) – reparation case concerning: neck and shoulder injury; quantum. Junior counsel to Simon Di Rollo QC.
- Unarranged overdraft bank charges litigation – longstanding series of litigation concerning the attempted reclaiming of charges by several hundred individuals. Issues covered include the conduct of litigation pending a test case on the matter, and appropriate court procedure. Appearances include the following cases:
