Summary
Fergus Thomson undertakes a full range of civil litigation and advisory work, with a particular interest in commercial, company, financial and insolvency-related matters.
Having originally called to the Bar in 2004 and practised there until late 2006, Fergus returned to practice as an Advocate in early 2009.
He has broad experience of appearing in a wide variety of courts and tribunals, including the Inner and Outer House of the Court of Session, the High Court of Justiciary and the Sheriff Court.
Fergus also has extensive experience both of work in the field of corporate finance and as a commercial solicitor, having spent several years working with two of Scotland’s “big four” legal firms. Latterly, as a solicitor, he specialised in banking and insolvency/restructuring work.
He is a member of The Society of Writers to Her Majesty’s Signet.
Selected cases
- Standard Life Assurance Company [2007] CSOH 137 – acted as Counsel for Standard Life plc in an insurance business transfer scheme under the Financial Services and Markets Act 2000 in relation to the de-mutualisation of Standard Life.
- PS Independent Trustees v Kershaw [2007] CSOH 50 – acted as Counsel for fifth defender in a claim by the independent actuary of a company pension scheme against the former scheme actuary and former directors/trustees in relation to losses to the scheme.
